Terms of Use

1. This agreement

These Terms of Use are an agreement between you and Utsav Patel ("we", "us"), the developer of Drawing Pad: Sketch & Ideas. By downloading or using the app you accept them. If you do not accept them, do not use the app.

This agreement is between you and us only, and not with Apple. We, not Apple, are solely responsible for the app and its content.

2. Your licence

We give you a personal, non-transferable, non-exclusive licence to use the app on any Apple device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

You may not sell, rent, sub-licence or redistribute the app; extract its bundled stickers, brushes or prompts for use outside the app; reverse-engineer, decompile or disassemble it except where the law says you may despite this sentence; or remove any notice of ownership from it.

3. What you draw

Your sketches are yours. Anything you create in the app is yours to keep, export, print or share, with no further permission from us. The bundled stickers, doodle art and drawing prompts remain ours; please don't repackage them as a standalone asset pack.

4. Premium: subscriptions and the lifetime unlock

The free version has daily limits on drawings and ideas. Premium removes them, either as an auto-renewable subscription or a one-time lifetime purchase — the exact options and prices are shown in the app and in your App Store subscription settings.

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price you agreed to.
• Manage or cancel a subscription any time in your Apple ID account settings — the app itself cannot cancel it for you.
• No refund is given for the unused portion of a period if you cancel partway through, beyond what Apple's own refund policy provides.

5. What it costs, otherwise

The base app is free to download, with no advertising. Premium is optional. We will not start charging for a feature you already have for free without a separate, clearly-labelled purchase.

6. Content the app downloads

Stickers and doodle artwork are fetched from our servers rather than fully bundled, so a connection is needed to browse the full library; downloaded items are then kept on the device. We try to keep this available, but we do not promise it will be, and we may change or stop it. Standard data charges from your carrier may apply.

7. Maintenance and support

We are solely responsible for any maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services. Reach us at utsavhacker@gmail.com — see the support page.

8. Warranty

The app is provided "as is" and "as available", without warranty of any kind, to the fullest extent the law allows. We do not warrant that it will be uninterrupted or error-free.

In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you, and nothing here removes rights you have as a consumer that cannot be removed by agreement.

9. Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost data, arising out of your use of the app. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or five US dollars.

Sketches live on the device, so a lost, wiped or replaced device loses them unless you have exported them yourself. Export anything precious.

10. Claims about the app

We, not Apple, are responsible for addressing any claims from you or a third party relating to the app or your possession and use of it — including product liability claims, any claim that it fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

11. Intellectual property

In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, we — not Apple — are solely responsible for the investigation, defence, settlement and discharge of that claim.

12. Third-party terms and Apple as beneficiary

You must comply with any applicable third-party terms of agreement when using the app — for example, your wireless data service agreement. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms of Use, and that upon your acceptance of them Apple will have the right to enforce them against you as a third-party beneficiary.

13. Changes to these terms

We may update these terms. The current version always lives at this address, with the date at the top. Continuing to use the app after a change means you accept the new version; if you do not, delete the app.

14. Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute — except that this does not deprive you of the protection of the mandatory consumer law of the country you live in, or of the right to bring a claim in your local courts where that law gives it to you.
